On Tuesday, November 13th, Rick did a case debriefing webcast for the NCAJ Autotorts Section about a $550,000 recovery on a Tractor Trailer/Wrongful Death case that had a very strong contributory negligence defense. Rick’s decedent driver turned left at an intersection directly in front of a clearly visible tractor trailer coming at him at 55 miles per hour. Rick shared several exhibits and discussed strategies that he used to convince Insurance Defense Attorneys, Claims Supervisor and Insured Defendant Truck Company Owner that Plaintiff had a good chance of recovering at trial using theories of Last Clear Chance, Gross Negligence, credible and sympathetic witnesses, and at worst, it was a good case to request a Comparative Negligence Instruction at trial and appeal it to the NC Supreme Court. Plaintiff’s Counsel felt that The NC Supreme Court (as it was and is presently constituted) might be ready to adopt Comparative Negligence as several neighboring courts have done, noting that 47 other states have adopted Comparative Negligence by legislation or court rulings.
